These Terms of Service (“Terms”) govern your use of the Precision Etch Company website and services. By accessing our website or submitting a quote request, order, or other inquiry, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Services Overview

Precision Etch Company provides custom fabrication services including laser cutting and engraving, 3D printing, CNC machining, and related production services. Our website allows you to:

• Request quotes for custom projects
• Submit orders for fabrication and production
• Configure birthday party packages (when available)
• Check the status of existing orders

2. Quotes and Pricing

• All quotes are estimates and are subject to change based on final design review, material availability, and project complexity.
• A quote is not a binding agreement until both parties have agreed on final pricing and specifications.
• Prices are quoted in Canadian Dollars (CAD) and do not include applicable taxes or shipping unless stated otherwise.
• Quotes are valid for 30 days from the date issued unless otherwise specified.

3. Orders and Production

Proof Approval

Before production begins, we provide a digital proof for your review and approval. It is your responsibility to verify all details including spelling, dimensions, design layout, and material selection. Once you approve the proof, we proceed with production based on the approved design.

Production Timeline

Estimated timelines are provided in good faith but are not guaranteed. Factors such as material availability, design complexity, and order volume may affect delivery dates. We will communicate any significant delays as soon as possible.

Modifications and Cancellations

• Design modifications requested before proof approval are generally accommodated at no additional cost.
• Changes requested after proof approval may incur additional charges and delay production.
• Orders that have entered production cannot be cancelled. Orders cancelled before production begins may be subject to a cancellation fee.

4. Intellectual Property

Your Content

You retain ownership of any designs, logos, artwork, text, or other content you provide to us. By submitting content, you grant us a limited license to use it solely for the purpose of fulfilling your order.

Our Designs

If we create custom designs or layouts for your project, intellectual property rights remain with Precision Etch Company until the order is paid in full, at which point the design rights for the specific commissioned work transfer to you.

Your Responsibility

You represent that you have the right to use any content you submit and that it does not infringe on any third party’s intellectual property rights. We are not responsible for verifying copyright or trademark ownership of submitted designs.

5. File Uploads

• Files uploaded through our website are stored securely in our Google Workspace environment.
• Accepted file types and size limits are indicated on each form.
• We are not responsible for files that fail to upload due to technical issues. If you are unsure whether your file was received, please contact us.
• Uploaded files are used solely for order fulfillment and are retained in accordance with our Privacy Policy.

6. Payment

Payment terms will be communicated as part of the quote and order confirmation process. We reserve the right to require payment or deposit before beginning production. Specific payment methods and terms will be arranged directly with your Precision Etch Company representative.

7. Delivery and Pickup

• Pickup: Orders designated for pickup will be available at our location. We will notify you when your order is ready.
• Shipping: Shipping costs are calculated based on destination, package size, and carrier rates. Risk of loss transfers to you upon handoff to the shipping carrier.
• We are not responsible for delays caused by shipping carriers, customs, weather, or other events beyond our control.

8. Quality and Defects

We take pride in the quality of our work and perform quality control checks before every order ships or is made available for pickup. If you receive an item that is defective or does not match the approved proof, please contact us within 7 days of receipt. We will work with you to resolve the issue, which may include remaking the item at no additional cost.

We are not responsible for issues arising from:

• Errors in the approved proof that were not caught during your review
• Variations inherent to natural materials (wood grain, leather texture, etc.)
• Minor colour differences between screen display and finished product
• Damage occurring after delivery

9. Limitation of Liability

To the maximum extent permitted by law, Precision Etch Company’s total liability for any claim arising from our services shall not exceed the amount paid for the specific order in question. We are not liable for indirect, incidental, consequential, or special damages, including lost profits or business interruption.

10. Website Use

• You agree to use this website for lawful purposes only.
• You will not attempt to interfere with the website’s operation or security.
• You will provide accurate information when submitting forms.
• We reserve the right to refuse service to anyone at our discretion.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be resolved in the courts of Ontario.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
